Maintaining confidentiality and commitment to confidentiality – policy

Graduate students are obligated to keep any information they have acquired or will acquire about research or other projects conducted at Bar-Ilan University or any other academic information of Bar-Ilan University (hereinafter: the information) confidential. Confidentiality of the information shall apply under the following binding conditions:

  1. The information or a part of it may not be disclosed to another person and/or any incorporated entity in any form.
     
  2. The information is to be strictly held and action should be taken to prevent its loss, handover, copy or transfer to others. In cases the information is lost, Bar-Ilan University is to be notified immediately.
     
  3.  All reasonable measures are to be taken to prevent access to the information by any person or incorporated entity.
     
  4. The information and all copies of it are to be returned to Bar-Ilan University and are to be deleted from all data repositories that belong to the student, so that no copy of it remains in the student’s hands, all this upon receipt of such a demand by Bar-Ilan University to return the information, or when there is no longer need for the information by the student for research purposes.
     
  5. In any case of doubt regarding essential responsibilities in this clause, students are to request clarification in writing from Bar-Ilan University before taking any action.
     
  6. No use of any kind shall be made of the information other than the use intended when provided to the student.
     
  7. All ownership rights of the information are and will be the sole property of Bar-Ilan University.
     
  8. The confidentiality commitment of the students shall apply to all parts of the information purchased or to be purchased from Bar-Ilan University, unless they can prove that:

    a. The information was known to them prior to receiving it from Bar-Ilan University.

    b. The information was common knowledge or was publicly accessible prior to the time it was given to the student by Bar-Ilan University.

    c. The information became common knowledge or became publicly accessible after the time it was given to the student by Bar-Ilan University, and the student was not responsible or connected to that.
     
  9.  The duty of confidentiality also applies to the student’s heirs, executors of the student’s estate and of the student’s last will and testament in the event of death.
     
  10. Israeli law shall apply to the duty of confidentiality. Jurisdiction shall be granted only to the competent court in Tel Aviv.
     
  11. The School of Graduate Studies shall not transfer review reports of assignments to any parties outside the university.
     
  12. Members of the permanent academic committee of the School of Graduate Studies shall be required to submit a declaration of confidentiality of committee meetings related to individual cases.
